These Terms of Service ("Terms") govern your use of AdBalloon, an AI-powered marketing service operated by Upcrossing AI Ltd ("AdBalloon", "we", "us" or "our").

By creating an account or using our services, you agree to these Terms.

1. Our Service

AdBalloon helps businesses create marketing content using artificial intelligence.

Depending on the features available to your account, the service may include:

• Business discovery and business profile analysis.
• AI-generated promotional videos, images and scripts.
• Uploading and managing business media assets.
• Reviewing and downloading generated content.
• Content planning, scheduling or publishing through supported integrations.

Features may change during product development. Some features may be unavailable during beta or pilot periods.

2. Eligibility and Accounts

AdBalloon is intended primarily for business use.

You must be at least 18 years old and have the authority to use the service on behalf of any business you represent.

You are responsible for maintaining the security of your account and for activities carried out through it.

You must provide accurate registration information and must not impersonate another person or business.

3. Your Content

You retain your rights in the images, videos, logos, text and other materials you upload or provide to AdBalloon.

By submitting content, you grant us a limited licence to host, process, reproduce and modify it as reasonably necessary to provide the requested services, including AI content generation.

You confirm that you have the necessary rights and permissions to submit and use the materials.

You must not upload content that infringes intellectual property rights, privacy rights or applicable laws.

4. AI-Generated Content

AdBalloon uses artificial intelligence to produce marketing materials. AI-generated outputs may contain inaccuracies, visual inconsistencies or content that does not fully reflect your business.

You are responsible for reviewing and approving content before using or publishing it, including checking factual claims, prices, promotions and applicable advertising requirements.

Subject to applicable law, third-party rights and your payment obligations, you may use outputs provided to you for your lawful business marketing purposes.

We do not guarantee that generated content is unique or eligible for exclusive intellectual property protection. Similar outputs may be generated for other users.

5. Business Information and Third-Party Sources

AdBalloon may use publicly available business information and information supplied by users to prepare business profiles and marketing materials.

Information obtained from external sources may be incomplete, inaccurate or outdated.

You should review your business profile and correct inaccurate information before relying on it for marketing purposes.

Third-party websites, platforms and services remain subject to their own terms and policies.

6. Publishing and External Platforms

Where publishing or scheduling integrations are available, AdBalloon will use connected accounts only within the permissions you authorise.

You remain responsible for complying with the rules of any external platform on which your content appears.

We cannot guarantee that external platforms will accept, publish or continue displaying content.

AdBalloon will not be responsible for external platform outages, account restrictions or policy changes outside our reasonable control.

7. Fees and Subscriptions

Some AdBalloon features may be offered free of charge, as trials, or under paid arrangements.

Where a paid service is offered, its price, billing period and applicable conditions will be communicated before purchase.

Any recurring charges, renewal arrangements and cancellation procedures will be explained in the relevant subscription or order terms.

Additional terms may apply to individual pilot agreements.

Nothing in these Terms excludes refund rights or other protections that cannot lawfully be excluded.

8. Acceptable Use

You agree not to:

Generated content and other features may depend on third-party AI and cloud services.

We may modify or discontinue features, providing appropriate notice where reasonably practicable.

10. Liability

AdBalloon does not guarantee particular commercial outcomes, including increases in followers, views, sales or revenue.

To the extent permitted by applicable law, we are not responsible for losses arising from inaccurate user-provided information, unreviewed AI-generated content or failures of independent third-party platforms.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or death or personal injury caused by negligence.

11. Termination
